This Personal Data Privacy Policy (the “Privacy Policy”) applies to all information that the online store vorteleather.com.ua, located at https://vorteleather.com.ua, may obtain about the User while using the Online Store website, programs, and products.

1. DEFINITIONS

1.1.1. “Online Store Website Administration (hereinafter — the Website Administration)” — authorized employees responsible for managing the website, acting on behalf of the online store VorteLeather, who organize and carry out the processing of personal data, and determine the purposes of processing, the composition of personal data subject to processing, and the actions or operations performed with personal data.

1.1.2. “Personal Data” — any information relating to an identified or identifiable natural person (the data subject).

1.1.3. “Processing of Personal Data” — any action (operation) or set of actions (operations) performed with personal data using automation tools or without such tools, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, and destruction of personal data.

1.1.4. “Confidentiality of Personal Data” — a requirement mandatory for the Administrator or any other person who has gained access to personal data to prevent its disclosure without the consent of the data subject or other lawful grounds.

1.1.5. “User of the vorteleather.com.ua Online Store Website” — a person who has access to the Website via the Internet and uses the Online Store website.

2. GENERAL PROVISIONS

3. SUBJECT OF THE PRIVACY POLICY

3.1. This Privacy Policy establishes the Website Administration’s obligations to refrain from disclosing and to ensure the protection of the confidentiality of personal data that the User provides at the Website Administration’s request when registering on the Online Store website or when placing an order to purchase Goods.

3.2. Personal data permitted for processing under this Privacy Policy is provided by the User by filling out the registration form on the Online Store website in the registration section and includes the following information:

5. METHODS AND TIMEFRAMES FOR PROCESSING PERSONAL INFORMATION

5.1. Processing of the User’s personal data is carried out without any time limitation by any lawful means, including in personal data information systems using automation tools or without such tools.

5.2. The User agrees that the Website Administration has the right to transfer personal data to third parties, including courier services, postal organizations, and telecommunications operators, solely for the purpose of fulfilling the User’s order placed on the Online Store website, including delivery of the Goods.

5.3. The User’s personal data may be transferred to authorized state authorities of Ukraine only on the grounds and in the manner established by the legislation of Ukraine.

5.4. In the event of loss or disclosure of personal data, the Website Administration informs the User of such loss or disclosure.

5.5. The Website Administration takes the necessary organizational and technical measures to protect the User’s personal information from unlawful or accidental access, destruction, alteration, blocking, copying, distribution, as well as from other unlawful actions by third parties.

5.6. The Website Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User’s personal data.

6. OBLIGATIONS OF THE PARTIES

6.1. The User is obliged to:

6.1.1. Provide personal data information necessary for using the vorteleather.com.ua Online Store website.

6.1.2. Update and supplement the provided personal data information in case of changes to such information.

6.2. The Website Administration is obliged to:

6.2.1. Use the obtained information exclusively for the purposes specified in Section 4 of this Privacy Policy.

6.2.2. Ensure that confidential information is stored in secrecy, not disclosed without the User’s prior written permission, and not sold, exchanged, published, or disclosed in any other possible manner, except as provided in clauses 5.2 and 5.3 of this Privacy Policy.

6.2.3. Take precautionary measures to protect the confidentiality of the User’s personal data in accordance with the procedure commonly used to protect such information in existing business practice.

6.2.4. Block personal data related to the respective User from the moment the User (or the User’s legal representative) or an authorized authority for protection of data subject rights submits a request for the period of verification, in case inaccurate personal data or unlawful actions are identified.

7. LIABILITY OF THE PARTIES

7.1. The Website Administration that fails to fulfill its obligations is liable for losses incurred by the User due to unlawful use of personal data in accordance with the legislation of Ukraine, except for the cases provided in clauses 5.2, 5.3, and 7.2 of this Privacy Policy.

7.2. In the event of loss or disclosure of Confidential Information, the Website Administration is not liable if such confidential information:

7.2.1. Became publicly available before it was lost or disclosed.

7.2.2. Was received from a third party before it was received by the Website Administration.

7.2.3. Was disclosed with the User’s consent.

8. DISPUTE RESOLUTION

8.1. Before filing a claim in court regarding disputes arising from the relationship between the User of the Online Store website and the Website Administration, it is mandatory to submit a claim (a written proposal for voluntary dispute resolution).

8.2. The recipient of the claim shall, within 30 calendar days from the date of receiving the claim, notify the claimant in writing about the results of the claim review.

8.3. If no agreement is reached, the dispute will be referred to a court in accordance with the current legislation of Ukraine.

8.4. The current legislation of Ukraine applies to this Privacy Policy and the relationship between the User and the Website Administration.

9. ADDITIONAL TERMS

9.1. The Website Administration has the right to make changes to this Privacy Policy without the User’s consent.

9.2. The new Privacy Policy enters into force from the moment it is posted on the Online Store website, unless otherwise provided by the new version of the Privacy Policy.
